The EmpCo Directive and its practical consequences
Anyone who advertises with environmental and sustainability claims in future must be able to prove this. The Empowering Consumers Directive (EmpCo) supplements the EU Directive on Unfair Commercial Practices and fundamentally changes the legal framework for advertising with sustainability claims.
What is the EmpCo Directive?
It aims to help consumers make sustainable purchasing decisions and prevent misleading environmental and social claims. The directive applies to all those who place goods on the EU market. In short: anyone who advertises sustainability must be able to prove it.
You need to know these deadlines
The directive has been in force since March 2024. EU countries must have transposed it into their national laws by 27 March 2026. Companies are obliged to remove all sustainability claims and seals from commercial communication that do not comply with the directive. They have until 27 September 2026 to do so.
